Booking

Processing an on-line reservation request or the booking form and paying your reservation deposit confirms your acceptance of the terms and conditions of this Villa Rental Contract and as may from time to time be changed and shall be binding on all persons stated on the booking form.
A booking request will be confirmed as final, one business day following the receipt of your deposit. Only upon receipt of the confirmation of the deposit receipt via email will the booking be treated as confirmed/final. The named person on the booking form (Signatory) will be responsible for the total rental price of the Villa, as agreed on the confirmation. The remaining balance of the agreed amounts must be paid six (6) weeks prior to your arrival at the Villa.

If the full balance of the rental cost is not paid in accordance with the booking conditions provided in the booking confirmation, Median reserves the right to cancel the booking and the cancellation penalty equivalent to the reservation deposit will apply.

Rental Price & Electrical Power Allowance

The rental price contained in the agreement includes the rental fees applicable to contracted arrival and departure dates as confirmed. There is an exit cleaning turn fee/surcharge of US$ 250.00 which is applicable on all bookings (quoted during the booking process). The invoice issued for the rental includes the rental price, exit cleaning fees, the applicable taxes and surcharges, or any additional item which have been pre-reserved at the time of booking and applicable on the rental.

All prices will be quoted in US Dollars (US$) unless specified differently and contained in your invoice(s) issued for your rental. Applicable to rentals of three (3) weeks or more – the monthly stay allowance for electrical power usage is four hundred dollars ($400.00). The Signatory is responsible for any power billing which is in excess of $400/monthly over the stay period. Excess power usage will be invoiced separately, and any electrical surplus usage will be deducted from the security deposit.

Security Deposit/Damage Deposit

Median collects a refundable Security Deposit/Damage protection charge of US$500.00 per stay. This is collected at least 2 weeks prior to the commencement of the stay. It is payable through PayPal. The sending of the booking form confirms your acceptance to pay for any damage of any kind caused by your occupancy of the property. The cost of repairs and/or replacements will be deducted from your security deposit prior to the return of the balance. The security deposit will be fully refundable within two (2) weeks after your departure from the Villa, providing there are no claims against it and all the provisions of this agreement are met.

a) No damage is done to the Villa or its contents, beyond normal wear and tear.
b) Excessive cleaning costs by our agents.
c) Excessive use of electricity (caused by leaving external doors open with the air conditioning on).
d) All debris, rubbish and discards, are to be placed in garbage/recycle bins, and soiled dishes, glassware and utensils are placed in the dishwasher and started following check-in process.
e) One load of laundry with the used beach towels is started if your departure is planned on a Saturday.
Note: all used bed linen is to remain on the beds and towels in the bathroom.
f) All keys are left on the key holder and the Villa is left locked (lockup key set is returned to the lockbox).
g) All additional charges accrued during the stay are paid prior to departure.
h) No linens/towels are lost or damaged.
i) No Early check-in or late checkout.
j) Garage door opener is left inside the Villa upon departure.
k) The renter is not evicted by the owner (or representative of the owner) or the local law enforcement.
l) The fireplace is not to be used during the rental period.
m) Garbage is collected by the city on Monday, and Thursday and the recycling collected on Thursday. All garage and recycling must be placed on the front curve for collection on earlier than 07:00am on the collection day.

In the event of any excess charges/damages of any kind, the named person on the booking form (Signatory) will be held responsible for all additional costs which exceed the security deposit.

Account Reconciliation Following Stay Completion

After the completion of the stay the host has 14 days to assess the property and submit a claim. In some instances, this may also include charges for incidentals (for example, excessive electricity utilisation, excessive cleaning fees, returning forgotten items, or damage from undeclared pets and guests).

Exceptions: Bookings made VRBO

Vrbo retains your payment card as a security to cover any damages that may occur during your stay and you are deemed to be responsible. This is not a pre-authorization “hold” on the credit card. After your stay is complete, Median has 14 days to assess the property and submit a claim including any excess power usage as contained in this Agreement. If Median files a claim, you will receive an email notification from Median indicating that a new charge has been added to your stay. The email will include a message from Median with a description of the damage including when and how much you will be charged. These charges will be applied to the payment method used for your booking for further information refer to the Property Damages section in the Vrbo terms of use.
If you purchased accidental damage protection through Vrbo, and the damage reported is covered under the policy, you can file a claim with the policy provider and request reimbursement for the resulting charge. Please review the policy coverage from Vrbo for additional information.

Cancellations

Providing Median receives written notice of cancellation of the reservation more than six (6) weeks prior to the arrival date at the Villa (stay commencement date), the Signatory is not liable to pay the full balance of invoice which has been issued for the booking. It is the responsibility of the Signatory to ensure that the signed cancellation letter reaches Median. Email cancellations are not acceptable.

In such an instance the following fees apply:
Stay Commencement: 42-days or more / Penalty/Fees: Booking Deposit Forteifed
Stay Commencement: 41-days or less / Penalty/Fees: Full Amount Rental

If Median is successful in renting the Villa for all or part of the reservation period, the full balance or the part balance of the final invoice will be refunded. Median reserve the right to cancel any bookings providing written notice is given and any balance paid refunded. In the unlikely event that circumstances beyond our control necessitate cancellation of the booking, we will refund any monies paid under the reservation (without interest, compensation or consequential loss of any kind).

Party Size

The maximum capacity that the Villa is able to accommodate is six Adults. Everyone occupying the Villa must be listed in this contract, including children. The accommodations cannot be shared, or sublet and only the persons listed in section 2) above are permitted to stay in the Villa.
Persons under 21 years of age are not acceptable as Signatory on the Rental Agreement.
Median and/or the owners reserve the right to refuse admittance if these conditions are not met. Failure to comply will render the booking void and no compensation will be paid or make any refund due to this action.

Responsibilities

All persons stated on the booking form is responsible for the care of the property and are expected to take reasonable care of it including the locking of all doors and ensuring the security alarm is activated whenever the property is unoccupied. At the end of the rental period, all utensils, carpets, furnishings, walls, fittings must be left clean and tidy. It is the guest’s responsibility to notify Median or its agent (Management Company) immediately of any sudden equipment failure so that reasonable action can be taken to rectify the situation.

Property Access

Villa access information will be forwarded two (2) weeks prior to arrival date at the Villa.

Smoking/Pets

For the safety, and comfort of all our guests smoking is NOT permitted within the Villa.
Pets are NOT allowed and/or permitted in the property.
Smoking within the Villa/Or having Pets within the Villa – will incur a cleaning fee of US$400.00.

Liability

The owners and Median and or the management company of the Villa accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings, however, caused. The use of all accommodations and amenities including the pool is entirely at the user’s own
risk. Children must be supervised by a responsible adult at all times, including when using the pool, spa or any facilities of the villa. Glass and/or crockery are not permitted within the pool/terrace area. The owners, Median and/or the management company cannot accept any liability for any loss of rental time due to travel problem, flight delays or cancellations, industrial disputes, weather or any events outside our control, including any form of Force Majeure. The owners, Median and the Management Company cannot accept responsibility for any sudden failure of Villa equipment but will take reasonable immediate action to rectify any such failure upon notification by the guests.

Force Majeure

The owners, Median and/or the management company accept no responsibility whatsoever, and no compensation or any other payment will be made if any cancellation or change to the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disasters, fire, flood, adverse weather conditions, building or construction in progress within the community, technical problems with transportation, closure or congestion of airports/roadways, alterations or cancellation of schedules by carriers, or any other events beyond our control.

Arrival and Departure

Unless specified on page 1 of this agreement, the Villa will be available for occupancy/check-in as of 4.00pm on the date of arrival and must be vacated by 10.00am on the day of departure to facilitate cleaning and inspection of the Villa. We will endeavour to accommodate arrivals/departure times outside of the stated times, subject to commercial demand.

Insurance

We recommend that all members of the Party be covered with travel insurance carrying adequate protection against delays and cancellations, and has adequate medical insurance for the USA, and for your luggage and personal belongings.

Owners Access

The owners, Median and/or the management company shall be allowed access at any reasonable time during your stay.

Law

This conduct is subject to and shall be construed in accordance with the laws of Montreal, Quebec, Canada and all parties hereby submit to the exclusive jurisdiction of the Canadian Courts of Montreal, Quebec.

Code of Conduct

The Villa is located within a residential community. The actions of all members of your party should not interfere with the enjoyment of other residents of the community. Use of the swimming pool, playing of loud music or engraining in any activity which may cause inconvenience to the neighbours should be avoided after 10:00pm and before 7:30am (during these hours we ask that you use good judgment). In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other residents of the neighbourhood or damage to any property, the owners, Median and/or their management company reserve the right to terminate the rental agreement immediately and forthwith. The owners, Median and/or their management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.

Payments

For customer convenience, a variety of payment options are offered to settle invoices/deposits. These options are provided at the time of booking and stated on the material issued with the invoice. Any refunds will be processed through the original payment method used.

Cleaning Service

Other than the exit cleaning service which is quoted for all stays, maid/cleaning service is not included in the rental rate. Additional cleaning and laundry services are available upon request. Advance arrangements must be made for additional maid/cleaning visits over your stay, as required. These additional visits will be agreed/confirmed and paid directly to the cleaning team by the guests,

Privacy

Any information provided by Customers on our website, or in the completion on any form that is requested or submitted within the rental process will be used solely for the purpose of renting the Villa or processing your Villa rental request and payments. Median will not pass any personal information to any other agencies or third parties whatsoever other than for the purposes of handling the booking/stay at the Villa. Median at all times respects the privacy of our customers.

Exceptions

Any exception to the above-mentioned Terms and Conditions must be agreed by the Parties and such exceptions must be confirmed/accepted in writing.

Language (Applicable to Canadian Residents Only)

The Parties agree that this Agreement and any documents ancillary thereto shall be drafted in English only.
